To use the Services, you must consent to and accept all of the Terms.
By employing the Services in any capacity, you agree to abide by these Terms, which will remain in effect while you use the Services. These Terms encompass the provisions in this document and those in the Privacy Policy.
Will these terms ever be updated?
We continuously work to enhance our Services, so these Terms may need to be amended in line with the Services. We hold the right to modify the Terms at any time. If we do, we will notify you by posting an announcement on the Giant Sentinel website, emailing you, or through other means.If you disagree with the updated Terms, you may reject them; regrettably, this means you will no longer have access to the Services. If you continue to use the Services after the Terms have been altered, you consent to all the changes.Except for alterations made by us as outlined here, no other revision or modification of these Terms will be effective unless in writing and endorsed by both you and us.
What about my privacy?
During the provision of the Service, Giant Sentinel will gather and process personal data about you and your usage of the Service. By using the Service, you agree that Giant Sentinel can utilize your personal data per our Privacy Policy and in accordance with the permissions you have granted us.Giant Sentinel will adhere to France and EU privacy regulations.
Are there age limitations?
Giant Sentinel is intended for individuals aged 18 and older. By using Giant Sentinel, you confirm that you are at least 18 years old. If we discover that someone under 18 is using Giant Sentinel, we will terminate their account. For usage in educational settings with students younger than 18 years old, please contact us.
What are the basics of using the Giant Sentinel Services?
ACCESS TO THE WEBSITE AND TO THE SERVICESAccess to the Website is free, except for the cost of connection through the telecommunications network supplied by the User’s provider. Access to the Services may be subject to remuneration in the conditions stated below and in the Website from time to time.The access and use of the Website and the Services requires a computer or computer equipment as well as internet connection. Any expense in connection with such items is not included in the Services described herein in the Terms and shall be borne exclusively by the User.
In order to use the Services, the User must sign in to his Gmail account (with Google’s authentication mechanisms -currently Oauth2-) by using a supported browser and install the Giant Sentinel extension in it, granting the authorizations requested for Gmail as they are necessary for the rendering of the Service (please see the Privacy Policy regarding the data to which Giant Sentinel access despite these authorizations).Giant Sentinel is not a service of Google Inc. Google Inc. and Giant Sentinel are two different unaffiliated companies; consequently, they do not represent each other.
The User undertakes to use the Services in good faith and not to use it negligently, for fraudulent purposes or in an unlawful manner. In addition, the User agrees not to take part in any conduct or action that could damage the image, interests or rights of the Services, other Users or of third parties.It is the User’s responsibility to ensure prior to using the Services that the features of the Services meet the User’s needs.
If you're agreeing to these Terms on behalf of an organization or entity, you represent and warrant that you are authorized to agree to these Terms on that organization or entity's behalf and bind them to these Terms (in which case, the references to "you" and "your" in these Terms, except for in this sentence, refer to that organization or entity).
You will only use the Services for your own personal or business use and only in a manner that complies with all laws that apply to you. If applicable laws prohibit your use of the Services, then you aren't authorized to use the Services. We can't and won't be responsible for your use of the Services in a way that breaks the law. You will not share your account or password with anyone, and you must protect the security of your account and your password. You are responsible for any activity associated with your account.
Your use of the Giant Sentinel Services is subject to the following additional restrictions: You represent, warrant, and agree that you will not contribute any Content or User Submission (each of those terms is defined below) or otherwise use the Services or interact with the Services in a manner that:
Infringes or violates the intellectual property rights or any other rights of anyone else (including Giant Sentinel);Violates any law or regulation;
Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable;Jeopardizes the security of your Giant Sentinel account or anyone else's (such as allowing someone else to log in to the Services as you);
Attempts, in any manner, to obtain the password, account, or other security information from any other user;Violates the security of any computer network or cracks any passwords or security encryption codes;
Runs Maillist, Listserv, any form of auto-responder, or "spam" on the Services, or any processes that run or are activated while you are not logged into the Services, or that otherwise interfere with the proper working of the Services (including by placing an unreasonable load on the Services' infrastructure);
Uses any intellectual property rights protected by applicable laws and contained in or accessible through the Services for the purpose of building a competitive product or service or copying its features or user interface;
Uses the Services or permits them to be used for purposes of product benchmarking or other comparative analysis intended for publication without Giant Sentinel's prior written consent;
Uses the Services to develop or enhance any software, software code, or any derivative works of any software without Giant Sentinel's prior written consent;
Uses the Services as a direct competitor of Giant Sentinel or for the purpose of monitoring the Services' availability, performance, functionality, or for any other benchmarking or competitive purposes;
"Crawls," "scrapes," or "spiders" any page, data, or portion of or relating to the Services or Content (through use of manual or automated means);
Copies or stores any significant portion of the Content;
Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to the Services.
As you are using Giant Sentinel to analyze and detect phishing attempts on Gmail, you are responsible for obtaining consents from all relevant parties, such as email senders and recipients, prior to using the Services. The analysis of emails, which may also contain personal data, is treated with the same level of care as the email content itself.
Giant Sentinel will not access analyzed emails or related data unless specifically requested by the user who utilized our Services for the analysis.A violation of any of the foregoing is grounds for termination of your right to use or access the Services.
What rights do I have with the Services?
The materials displayed, performed, or available through the Services, such as text, graphics, data, articles, photos, images, illustrations, User Submissions, and more (collectively, the "Content"), are protected by copyright and/or other intellectual property laws. You agree to comply with all copyright notices, trademark rules, information, and restrictions contained in any Content you access through the Services.
You will not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell, or otherwise exploit any Content not owned by you, (i) without the prior consent of the Content owner or (ii) in a manner that violates the rights of others (including Giant Sentinel's rights).
You understand that Giant Sentinel owns the Services. You will not modify, publish, transmit, participate in the transfer or sale of, reproduce (except as expressly provided in this Section), create derivative works based on, or otherwise exploit any aspect of the Services.The Services may allow you to copy or download specific Content; remember that all the restrictions above apply when copying and downloading such Content.
Who is responsible for the content and actions related to the use of Giant Sentinel's Services?
Any information or content processed by Giant Sentinel's Services is the sole responsibility of the user who submits it. You access and interact with all such information and content at your own risk, and we are not liable for any errors, omissions, or any damages or losses you may experience in connection with it. We cannot control and have no obligation to take action on how you may interpret and use the content or what actions you may take as a result of using Giant Sentinel's Services. You hereby release us from all liability for acquiring or not acquiring content through our Services.
We cannot guarantee the identity of any users you interact with while using our Services and are not responsible for determining which users have access to the Services.You are responsible for all content you submit to Giant Sentinel's Services in any manner, and you represent and warrant that you have all the necessary rights to do so. You will maintain the accuracy and currency of all your registration information.
You are responsible for all your activities in connection with the Services.Giant Sentinel's Services may analyze emails that contain links or connections to third-party websites or services not owned or controlled by Giant Sentinel. When you access third-party websites or use third-party services, you acknowledge the risks involved and agree that Giant Sentinel is not responsible for such risks. We encourage you to be aware of the risks associated with third-party content and to read the terms and conditions and privacy policies of each third-party website or service you access. Giant Sentinel has no control over and assumes no responsibility for the content, accuracy, privacy policies, practices, or opinions expressed in any third-party websites or by any third party you interact with through our Services.
Furthermore, Giant Sentinel will not and cannot monitor, verify, censor, or edit the content of any third-party site or service. By using our Services, you release and hold us harmless from any liability arising from your use of any third-party website or service.Your interactions with organizations and/or individuals found on or through Giant Sentinel's Services, including the analysis of emails related to third-party goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and those organizations and/or individuals.
You should conduct any necessary or appropriate investigations before proceeding with any online or offline transactions with any of these third parties. You agree that Giant Sentinel shall not be responsible or liable for any loss or damage incurred as a result of such dealings.If a dispute arises between users of our Services or between users and any third party, you agree that Giant Sentinel is under no obligation to become involved.
In the event of a dispute with one or more other users, you release Giant Sentinel, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services.
Disclaimer regarding the use of Giant Sentinel:
Giant Sentinel strives to analyze and detect phishing attempts in emails. However, we cannot guarantee 100% detection of phishing emails or the accurate classification of all emails as safe or unsafe. By using Giant Sentinel, you understand and agree that our service aims to mitigate risks but cannot completely eliminate the risks associated with phishing and fraudulent emails.Giant Sentinel shall not be held liable if a user chooses to click on links within an email identified as phishing or not.
The user is responsible for their own actions and should always exercise caution when interacting with emails and the links they contain.Furthermore, Giant Sentinel cannot be held responsible in cases where an email is identified as safe when it is not, or vice versa. Users should continue to exercise judgment and caution when interacting with emails, even when they are analyzed by our service.Any information, advice, or recommendations provided by Giant Sentinel should not be considered as legal, professional, or technical advice.
The Service is provided for general informational purposes only and is not intended to replace or substitute for the advice of an expert in the relevant field. Users are advised to consult with appropriate professionals for specific advice tailored to their situation.
Giant Sentinel shall not be held responsible or liable for any decisions or actions taken by users based on the information, advice, or recommendations provided by the Service.
By using Giant Sentinel, you agree to release Giant Sentinel, its officers, employees, agents, and successors from any liability, claim, demand, or damage of any kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in connection with the use of our service to analyze and detect phishing attempts and other fraudulent emails.
Please ensure to exercise caution and common sense when interacting with emails, even when they have been analyzed by Giant Sentinel.
Will Giant Sentinel ever change its Services?
We constantly strive to improve our Services, so they may change over time. We may suspend or discontinue any part of the Services, introduce new features, or impose limits or restrictions on certain features, or restrict access to parts or all of the Services.
We will try to give you notice when we make a material change to the Services that would adversely affect you, but this may not always be practical. Similarly, we reserve the right to remove any content from the Services at any time, for any reason (including, but not limited to, if someone alleges you contributed that content in violation of these terms), in our sole discretion, and without notice.
Do the Services have any costs?
Some of Giant Sentinel's Services are currently free, but we reserve the right to charge for certain or all Services in the future. We will notify you before any Services you are currently using begin carrying a fee, and if you wish to continue using such Services, you must pay all applicable fees for those Services.If you choose to sign up for any Services that carry a fee (the "Paid Services"), you will be charged the current fees for those Paid Services.
Giant Sentinel shall refund the User the total amount paid in the event that User terminates the use of the Services for Purchase within 30 days from its purchase. To such extent, the User shall contact Giant Sentinel through hello@giantsentinel.com
What if I want to stop using the Services?
You are free to do that at any time by contacting us at hello@giantsentinel.com. Please refer to our Privacy Policy, as well as the licenses above, to understand how we treat the information you provide to us after you have stopped using our Services.Giant Sentinel is also free to terminate (or suspend access to) your use of the Services or your account for any reason in our discretion, including your breach of these terms. Giant Sentinel has the sole right to decide whether you are in violation of any of the restrictions set forth in these terms.
Account termination may result in the destruction of any content associated with your account, so keep that in mind before you decide to terminate your account. We will try to provide advance notice to you prior to terminating your account so that you can retrieve any important data you may have stored in your account (to the extent allowed by law and these terms), but we may not do so if we determine it would be impractical, illegal, not in the interest of someone's safety or security, or otherwise harmful to the rights or property of Giant Sentinel.
If you have deleted your account by mistake, contact us immediately at hello@giantsentinel.com – we will try to help, but unfortunately, we cannot promise that we can recover or restore anything.Provisions that, by their nature, should survive termination of these terms shall survive termination. By way of example, all of the following will survive termination: any obligation you have to pay us or indemnify us, any limitations on our liability, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us.
What else should I consider?
Warranty Disclaimer
Giant Sentinel offers the service to you "as is." Please be aware that the service is not error-free. By using the service, you assume all risks and acknowledge that it comes without any warranty, either expressed or implied. As the service will be continuously updated, changes to features and layout may occur without prior notice. Giant Sentinel provides no warranties, either expressed or implied, concerning the service's availability, merchantability, fitness for a specific purpose, non-infringement, accuracy, completeness, performance, or quality.
Occasionally, Giant Sentinel may need to perform updates and maintenance for technical, security, or operational reasons, during which the service could be unavailable. Reasonable efforts will be made to schedule updates and maintenance outside of peak usage hours.
Liability Limitation
Giant Sentinel shall not be responsible for any damages arising from law, contract, warranty, indemnification, tort, or any other sources, including, but not limited to, incidental and consequential damages, loss of profits or business opportunities, or damages resulting from data loss or lack of access to the service. In any event, Giant Sentinel's total liability shall not surpass the amount you have paid for the service within the last 12 months prior to the incident causing the liability.
Giant Sentinel does not guarantee that the analysis and results of emails provided by the Service are infallible. While we strive to improve the accuracy and reliability of the Service, the results may contain errors, false positives, or false negatives. Giant Sentinel shall not be held liable for any damages or losses resulting from reliance on the Service's email analysis or any inaccuracies contained therein.Users acknowledge and agree that the Service is provided on an "as-is" basis and that they use the Service at their own risk.
Giant Sentinel makes no representations or warranties about the suitability, reliability, availability, or accuracy of the Service for any purpose.Giant Sentinel shall not be liable for any indirect, punitive, special, or consequential damages, or any damages whatsoever, including, without limitation, damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of the Service, whether based on contract, tort, negligence, strict liability, or otherwise, even if Giant Sentinel has been advised of the possibility of damages.If you are dissatisfied with any portion of the Service, or with any of these terms and conditions, your sole and exclusive remedy is to discontinue using the Service.
Indemnification
By using the Service, users agree to indemnify, defend, and hold harmless Giant Sentinel, its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all third party claims, losses, liability, damages, and costs (including, but not limited to, reasonable attorney's fees) arising from their use of the Service, their violation of these terms and conditions, or their infringement or violation of any rights of others.
Partial Invalidity
If a court or other binding authority declares any provision of the terms invalid or unenforceable, the remaining terms (or parts), conditions, and provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
Force Majeure
Force Majeure refers to any circumstances beyond either party's reasonable control, including, without limitation, fire, explosion, strikes or other labor disputes, riots or other civil disturbances, voluntary or involuntary compliance with any law, order, regulation, recommendation, or request of any governmental authority, and errors or downtime in networks, power supply, gateway, or similar communication failures. Neither party will be liable, aside from the payment of money owed, for their failure to fulfill any contractual obligations due to force majeure events.
Assignment
You are not permitted to assign, delegate, or transfer these Terms, your rights or obligations under them, or your Giant Sentinel account in any manner (by operation of law or otherwise) without prior written consent from Giant Sentinel. We reserve the right to transfer, assign, or delegate these Terms and our rights and obligations without obtaining consent.
Choice of Law and Dispute Resolution
These Terms will be governed by and interpreted following French law. Any disputes, controversies, or claims arising out of or in connection with the Terms shall be subject to the jurisdiction of the French courts, with the district court of Bordeaux, France, as the legal venue.
Miscellaneous
You are responsible for paying, withholding, filing, and reporting all taxes, duties, and other governmental assessments associated with your activities in connection with the Services. However, Giant Sentinel may, at its sole discretion, perform any of the foregoing on your behalf or for itself as it deems appropriate. Failure by you or us to exercise any right herein shall not be considered a waiver of any further rights under these Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms remain in full force, effect, and enforceable. You and Giant Sentinel agree that these Terms represent the complete and exclusive mutual understanding between you and Giant Sentinel, superseding and canceling all prior written and oral agreements, communications, and other understandings relating to the subject matter of these Terms.
All modifications to these Terms must be in writing and signed by both parties (except as otherwise provided herein). These Terms do not create any agency, partnership, joint venture, or employment relationship, and you have no authority to bind Giant Sentinel in any respect.
You and Giant Sentinel agree that there are no third-party beneficiaries intended under these Terms.
